1. Acceptance of Terms

By accessing or using Clawdex ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Clawdex is an AI-powered WhatsApp chatbot platform for businesses. The Service includes:

• AI-powered automated responses to WhatsApp messages
• Business dashboard for configuration and analytics
• CRM pipeline and customer management
• Sales Engine for lead generation (Enterprise plan)
• Broadcast messaging capabilities

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to use the Service
• One business per WhatsApp number unless on Business or Enterprise plan

4. Subscription Plans & Billing

• Billing is processed monthly through Lemon Squeezy
• You may cancel at any time; service continues until the end of the billing period
• Refunds are handled on a case-by-case basis within 14 days of purchase
• We reserve the right to change pricing with 30 days notice

5. Acceptable Use

You agree NOT to use the Service to:

• Send spam or unsolicited messages
• Violate WhatsApp's Terms of Service or Business Policy
• Distribute malware or malicious content
• Impersonate another person or entity
• Conduct illegal activities
• Abuse rate limits or attempt to circumvent usage restrictions
• Scrape data for purposes outside the Sales Engine's intended use

Violation of these terms may result in immediate account suspension without refund.

6. AI-Generated Content

• Responses generated by AI are not guaranteed to be accurate
• You are responsible for reviewing and configuring your AI agent's behavior
• Clawdex is not liable for actions taken by customers based on AI responses
• You can customize the AI's personality, knowledge base, and restrictions through the dashboard

7. Data Ownership

• You own your business data, configurations, and customer conversations
• We do not claim ownership of content generated through the Service
• You grant us a limited license to process your data solely to provide the Service
• You are responsible for complying with data protection laws applicable to your customers

8. Service Availability

• We aim for 99% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be communicated in advance when possible
• We are not responsible for downtime caused by WhatsApp, AI providers, or infrastructure providers

9. Limitation of Liability

To the maximum extent permitted by law, Clawdex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

• You may terminate your account at any time through the dashboard or by contacting us
• We may terminate or suspend your account for violation of these Terms
• Upon termination, your data will be retained for 30 days, then permanently deleted

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions.
